The Recording Industry Association of America (RIAA) has gone after thousands of individuals due to damages it claims that have been caused by illegally downloading music. Most people have settled out of court, but one person is fighting back. Tanya Andersen, a 41-year-old disabled single mother from Oregon, is counter-suing the RIAA for entering and taking information from her computer without her permission. Ms. Andersen’s claim seeks damages under the RICO act (Racketeering and Corrupt Organizations) , putting RIAA on the same level as your average organized crime family. Ms. Andersen’s alleges that the RIAA has “abused the judicial system,” and used third-party companies to hack into her computer system. The part that makes me laugh the most is in her suit it notes
that contrary to the RIAA lawsuit, she “does not like ‘gangster rap,’ does not recognize the name ‘gotenkito,’ is not awake at 4:24 a.m. and has never downloaded music.
Anderson has also demanded a trial by jury. Priceless. I wonder if all the RIAA lawsuits had any effect on the fact that sales of digital music have tripled. Maybe just a little.
